Following the verdict of the Taraba Election Petition Tribunal which annulled the election of the state Governor, Darius Ishaku, Counsel to the petitioner and candidate of All Progressives Party (APC) in the election, Hajia Aisha Alhassan, Mahmoud Magaji (SAN) has described the Tribunal’s ruling as victory for democracy.
Reacting to the verdict of Justice Musa Abubakar-led tribunal in a chat with The Post, Barrister Magaji said the aspiration of the Taraba state voters has finally manifested.
“I want to see it as a victory for democracy and the rule of law that at least the intentions and aspirations of the voters is clearly manifested. And that they will have the representation that they voted for. I am particularly happy for the judiciary.
“I am happy for myself and happy for the APC candidate in that election and I wish her the best of luck in trying to deliver the dividends of democracy,” a happy Magaji said.
Fielding questions on the expected move of the defendant to go to the Court of Appeal, Mr Magaji chose his words carefully saying that it is the right of the defendant to remain in power pending when the verdict of the Appellate court.
“It is their constitutional right. It is the right of anybody to go the Court of Appeal and nobody can take it away from them.
“It is the right of the other party and by virtue of section 143 he is bound to stay in power until after the appeal is finally disposed of,” he said.
Efforts to reach APC’s National Woman Leader Hajiya Ramatu Tijjani Aliyu and its spokesperson, Alhaji Lai Mohhammed proved abortive as they refused to pick up their calls.
However, it was gathered that the party’s hierarchy were celebrating the court’s verdict.
