A Kogi State High Court sittibg in Lokoja has on Wednesday granted the embattled senator representing Kogi West Senatorial district Senator Dino Melaye bail over the allegation of dealing in Illegal firearms.,
In his ruling, the Chief Judge of Kogi State,Justice Nasiru Ajanah has disclosed that heath situation of the accused person is enough reason to grant bail, adding that the offence alleged is not capital in nature.
Justice Ajanah explained that the complainant has failed to show that if granted bail,the accused will jump bail.
He however admitted Senator Melaye to bail with of N10 million and surety in like sum ,affidavit to prove and passport photographs .
“The health situation of the 3rd defendant had earlier been admitted by the complainant to be such that they do not have adequate facilities to take care of him is a factor which merits consideration in this case”.
He further stated that as at the time of this application made, the 3rd defendant was at Police Headquarters in Lokoja and the complainant has expressly stated that they had no medical facilities
“From the documentary every fence proffered there is no doubt that the 3rd accused person is suffering from some kind of ailments In addition to asthma which the 3rd defendant is suffering from the medical examination carried out on him,”he stressea
Senator Dino Melaye along with Kabiru Seidu a.k.a Osama and Nuhu Salishu a.k.a Small before a magistrate court in Lokoja where he was remanded in Police custody under the Inspector General of Police.
Subsequently the defendant legal counsel Chief Mike Ozokheme file application for bail at state High Court upon which the complainant leading counsel Dr.Alex Izinyon filled counter affidavit to remained the the embattled Senator in Prison custody.
Following the earlier application for vary the earlier order of Senior Magistrate Court to remand in Police custody with medical facility, the Chief Judge had granted a relief that Senator Melaye be taken to the National Hospital in Abuja where had detained in past two weeks.
While speaking to newsmen after the ruling, the legal counsel to the Senator Dino Melaye, Chief Mike Ozokheme stated that judiciary still remain the last hope of common man.
He commended the Chief Judge of Kogi State to towing the path of justice.
