Court Frustrates Gov Bello From Implementing White Paper of Judicial Panel Inquiry

The move by the present administration to probe past administrations may have suffered frustrations as  a Kogi State High Court sitting in Lokoja has restrained Governor Yahaya Bello from implementing the white paper of  a judicial panel of inquiry he set up to probe the finances of the past administrations in the state.

A copy of the order paper obtained by the  on Thursday in Lokojawhich was made available journalists in Lokoja.

In his ruling Justice Sunday Otu also granted an order of injunction restraining the state governor from implementing the report of the judicial penal of inquiry.

The restraining order which was granted on December 18th, 2017  followed an ex parte  motion filed and moved  by a Lokoja -based lawyer, Mr Joel Usman on behalf of his client, Mr Umar Mohammed who was a former Commissioner in the state.

Other respondents in the suit are  the state  attorney -general and Commissioner for justice and the White Paper Implementation Committee.

Governor Bello had earlier in July 2016 inaugurated a seven- member panel headed by a retired Kano State high court judge, Justice Ibrahim Wada to probe past administrations in the state from May, 2003 to Jan. 26, 2016.

Both Alhaji Ibrahim Idris and Capt. Idris Wada were the governor’s of the state during the years under probe.

The exparte motion with number HCL / 585m/ 2017 with affidavit in support the exhibits  filed on December  4th  is asking the court to order the respondents to produce the white paper and the reports of the judicial panel of inquiry for the purpose of being quashed .

It is also seeking the leave of the court to grant leave to  Mohammed to apply for judicial review of the white paper and prohibit the respondents from implementing the content of the white paper and or reports of the judicial commission of inquiry.

In addition, the court should also make an order restraining the respondent and their agents from implementing the white paper and or reports of the judicial commission.

The matter has been adjourned till Jan. 18, 2018 for hearing.
